Kerala HC grants bail to man who attacked mother over money

Kochi: The Kerala High Court has granted bail to a man accused of repeatedly attacking his mother with a knife after she refused to give him money to celebrate New Year's Eve last year. The decision was made after the woman informed the court that she could not bear to see her son languishing in jail.

Justice P V Kunhikrishnan, while granting bail, acknowledged the deep emotional bond between a mother and her child. “I am sure that the wounds on her body might not have healed, but her love for her son takes over the wounds. Thinking of the fate and trauma facing the mother, I am forced to grant bail to the petitioner. A mother’s love for her son is like a rose—it will bloom forever,” the judge remarked.

At the same time, the court expressed concern over the state of today's youth, calling their mental condition “astonishing and disturbing.” It noted that attacking one's own mother over money for celebrations was alarming and highlighted the need for society and parents to monitor the younger generation closely, ensuring they associate with the right people.

The 25-year-old accused was granted bail on the condition that he executes a bond of Rs 50,000 with two solvent sureties for the same amount. The court emphasized that keeping him in detention would serve no purpose other than extending his mother’s trauma.

Additional bail conditions include mandatory appearance before the investigating officer every Monday at 10 a.m. until the final report is filed. The accused must cooperate with the investigation, refrain from influencing or intimidating witnesses, and cannot leave the country without court permission.

The High Court further ruled that if the accused engages in any criminal activity, his mother has the right to report it to the jurisdictional police station. In such a case, the Station House Officer must file an application for the cancellation of bail.

The accused was arrested on January 1 and booked under sections 118 (causing grievous hurt with a weapon) and 109 (attempt to murder) of the Bharatiya Nyaya Sanhita.
